ENOS KNAPP'S LAST WILL & TESTAMENT -- D IED 1824

I, Enos Knapp of Greenwich in Fairfield County the State of Connecticut make this my last will & testament as follows:

1st I order my debts to be paid out of my personal estate

2nd I give & bequeath to my wife Mary all my beds & bedding to be her own absolutely and the use of all the rest of my household furniture during life. I devise to my said wife the use of my dwelling house & one half of the garden and one half of the orchard adjoining with one half of the barn together with the use of one third of the remainder of my real estate during her life subject to impeachment of waste.

All which is to be to my said wife in lieu of Dower--I give & devise to my son Isaac Knapp and his heirs and assigns a tract of land lying near D~Darius Meads containing four acres & an half bounded north & west by highway South by Robert Johnsons land East by land now occupied by Whitfield Peck's tract being near. Isaacs dwelling house bounded North& East by highway west by his own land South by Ebenezer Peck's land.

Also one tract of about four acres more or less bounded West & South by long meadow beach East by a long ditch North by Ebenezer pecks land with the privilege of a drift way there from along the side of said Peck land through my land Easterly to the highway

Also one acre of all meadow bounded Easterly & Southerly by a small creek Westerly by a long ditch Northerly by land hereinafter devise to my son Enos Knapp Jr also two tracts of wood land one of two & an half acres more or less bounded northerly partly by James Rath's & partly by Silas Davis land Easterly by a{?}patch southerly by the heirs of Peter Jessup Dec'd. Westerly by the heirs of David Ferris Jr, Dec'd. The other of six and an half acres more or less bounded southerly by Lemuel Ferris Easterly partly by D.? Ferris and partly by Silas Burley northerly by P? Ferris Westerly by Solomon Ferris. I also give my said son one half of my cider mill exclusive of the fee of the ground whereon it stands. The aforesaid devise to my (said?} son Isaac being subject to the use of the third of the remainder of the real estate before given to my wife in proportion to the value of {said} diveses.

4th I give and bequeath & devise to my son Enos Knapp Jr, & his heirs

my homestead & the buildings thereon being three acres and an half more or less bounded East South & part west by highway part west by Ebenz. Peck north by his own land subject to my wife's use and afores..(said?) One tract of land of about eight acres bounded East North & West by highway South part by Seth Palmer & part by Peter Lockwood exclusive of one half of my Cidermill before given herein to my son Isaac One tract of land of about ten acres near Lattins Rock west by highway. North & East {?}Joseph pellock South by Ebez/. Peck. One trackt of about four and an half acres bounded West by Ebez. Peck in past & part by the long ditch aforess{said} South by the acre of abt meadow f\herein before given to my son Isaac Easterly by Joseph Ferris North by highway. P tracts to be my s. son Enos his heirs and assigns subject to the use of my said wife in the third part of my real estate as fores. In proportion to the value thereof & subject tot he right of drift way before provided for my son Isaac.

5th I give and devise to my grandchildren David Peck Dharel Peck Enos Peck Sally Peck and Rhoda Peck children of my Dau Daughter Mary Peke wife of Whitfield Peck and to their heirs and assigns. To be equally divided between them a tract of land with the buildings thereon where S? Whitfield now lives continuing three acres more or less bounded north by the road East by Jaber Mead & south by Mores Peck west by land herein before devised to my son Isaac. Subject to the proportion of the use of one third of my real estate to my wife as afore, vis of the remainder aforesaid.
6th I give and bequeath to my daughter Rhoda, wife of Benjamin Page, two hundred dollars to be paid within one year after my decease by my executor our of my personal estate and if that after paying the debts and charges against my estate & exclusive of that to be held by my wife should be insufficient to pay s(aid) two hundred dollars the deficiency is to be paid by my son Enos & the levies to him are hereby charged therewith. should there be a residue of personal estate after satisfying the foregoing provisions of this my will I give & bequeath the same to my s(aid)children Isaac, Enos, and Rhoda to be divided equally between them.....----

Lastly, I appoint my s(aid) sons Isaac and Enos Executors of this my last will & testament.

In confirmation whereof I have hereunto set my hand & seal this tenth day of June anno Domini one thousand eight hundred & twelve.

Fairfield County of Stamford, June 10th 1812, Personally appeared Mary Davenport and Jerusha Davenport both of Stamford and made oath that they saw Enos Knapp of Greenwich sign and seal the foregoing writing that they heard him publish the same as his last will & testament that he appeared to them at the same time to be of a sound disposing mind and memory and that they at the same time together with Ebenezer Davenport of Stamford subscribed their names as witnesses to the same at the desire & in the presence of the Testator.


Before me. Ebenezer Davenport Justice of Peace.
I Enos Knapp of Greenwich in Fairfield County Connecticut do make this addition to my last will & testament before written(viz) I give to my wife Mary my one cow & one swine such as she shall choose & grain harvested and other provisions that may be in my house & barn at my decease & one half of the grain growing on my lands at that time in addition to what I have before given to my said wife a(fore)s(aid) will which I do so for order shall be considered as an attestation of & an addition to my s(aid) will. witness my hand & seal this eleventh day of June anno Domini one thousand eight hundred & twelve

Fairfield County of Stamford June 11th 1812, Personally appeared Jrusha Davenport & Mary Davenport both of said Stamford and made oath that they saw Enos Knapp of Greenwich sign and seal the writing last afores(aid) that they heard him publish the same as an addition to his last will and testament herein before written that he appeared to them at the same time to be of a sound disposing mind and memory and that they at the same time together with Ebenezer Davenport of Stamford subscribed their names as witnesses to the same at the desire and in the presence of the testator.

At a Court of probate holders at Stamford in & for the district of Stamford on the 24th day of Nov 1824 ?Preceut? Ebz Hawley Judge , Isaac Knapp & Enos Knapp named as Executors of the will presented the same with the codicil thereto annexed here in court & on their motion said will & codicil are by this court adjudged to be proved by the foregoing testimony and are approved & ordered to be accorded said Enos & Isaac have here in Court accepted & undertaken the trust of executing said will & have given bond according to law which is on file & on their motion this Court appoints Drake Lockwood & Mahel Paleues disinterested freeholders of said Greenwich appraisers of the estate of said Enos Dcsd & which? six months from this date for the executors to said estate to exhibit their claims against the same & said Executors are ordered to give public notice thereof according to law.

M a Court of Probate holden at Stamford in & for the District of Stamford on the 3rd day of Dec. 1824 Enos Knapp one of the Executors of th last will & testament of Enos Knapp , dec., presented the foregoing inventory to this court & on his this s(aid) Enos oath the same is accepted & ordered to be accorded. M a Court of probate holden at Stamford in & for the District of Stamford on the 15th day of Dec AD 1824, present Chs Hawley, judge, Mary the window of Enos knapp late of Greenwich(in of said District Dec d. having by Certificate which is on file signified to this court that she accepts the provisions made for her by her husband will in him by dower on motion attestors Drake Lockwood Mahel Palmer * Seth Lyon indifferent freeholders of said Greenwich distributors to set ou t to said widow that portion of the real estate left by the dcd. To which she is by his will entitled viz one half 0f the garden one half of the orchard adjoining once half of the barn & one third of the remainder of the real estate of said Decd. To be held by said widow during her life and said distributors are to set out to said widow that the bequest to Isaac Knapp that to Enos Knapp & that to the children of Mary the late wife of Whitfield Peck, decd. Shall each be subjected to the claim of the widow in proportion to its value and said distributors are to make return of their doings together with this order to this court within ten weeks from this time.-----atest Ch. Hawley Judge

By order of the Hon Court of Probate holden at Stamford in & for the district of Stamford on the 15th day of Dec ad 1824, Present Ch Hawley Judge
We have distributed & set out to Mary the widow of Enos Knapp lat of Greenwich, dec.d in said district that portion of the real estate aft by the decd to which she is by his will entitled according to the tenor of the will & the order of Court given us as follows, viz


We have set to her in the bequeath he made to the children of Mary the late wife of Whitfield Peck (deced) one acre & one wod of land bordered on the west by land of said Enos Knapp, decd., which he gave in his said will to Isaac Knapp & South by land of Mary Peck 3 chains 53 links, East by land given by said Decd to the children of said Mary Peck late wife of said Whitfield & North in part by the same land & by highway.

We have set to her in the bequest to Isaac Knapp two acres two rods 13 rods of land in the river lots bounded north by the highway & land of Benjamin Page West by B Page & a road South by land of Paris Robins and East by land of said decd. In his bequest to said Isaac as the Fence now stands and one acre of salt meadow in the gate clew so called bounded west by the long ditch South by Reuben Lockwoods land East by land in the bequest of said decd to Enos Knapp & north by the same land or a stradtway leading to land of said Isaac and one acre and 10 rods of land in the lower woods bounded north by land of Lemuel Ferris 8 chains 92 links measured westerly to a pile of stone thence on the west by land of said Decd. 1 chain 20 link measured southerly from said pile of stone to the top of a large rock & on the south by land of said decd from said rock to the northwest corner and of Silas Bunley thence South by land of said Burley & east by land on said Lemueal Ferris with right to pass through the drift way to her said land. And we have set to her one third part of the use of the cider mill or the privilege of the one third part of said mile & the south part of the cider mill chamber as far north as the fourth rafter with the privilege to ?pass from the stairway to her part on the east side of said chamber, this said cider mill being given by said de cd. To Isaac Knapp & Enos Knapp in his said will..and we have set to her in the bequest to Enos Knapp the southwest lot in a tract called the wills lot bounded on the west by the road south by land of Ebenezer Peck East & north by land of said deceased as the fence now stands said lot containing 2 acres & 20 rods. And we set to her 4 acres 3 rods & woods in the north end of the meadows south of the dwelling house of said decd. Bounded on the east north & west by the highway on the south by land of said decd. The west corner of this lot is 6 chains 63 links from the south west corner of the whole tract of said decd & the east corner of the said lot set to her is 4 ch. 27 links from the southeast corner of the whole tract measured on both sides by the road reserving to this said widow & said Enos the privilege of taking up & removing the port & rail fence on the north part of this lot for the purpose ofbuildinga division fence between them on said lot * we have set to her the west and as hay of the barn with the privilege or use of the barn floor in common with Enos Knapp & we set to her the use of the scaffold over the north half of the barn floor & we set to her the west part of the barn yard being west of the west door post of the barn & the west bar post in the front of the barn with the right to pass through the bar & yard to the barn floor and we have set to her in the south part of the orchard adjoining the house one acre & 3 rods of land bounded on the south by the house garden barn barnyard & on the east by the road 3 chains 7 ln. measured from the northeast corner of the barn northerly to stone bounds set up by the fence north by land of said decd. West by land of Ebenezer Peck 80 links & furtherward by a lot called the hog pasture as the fence stands & we have set to her the north half of the garden being 23 links wide at the west end & 29 links wide at the east and & the dooryard of the dwelling house with a right to pass around the west end of the house one rod from the house & no further U& we reserve to Enos Knapp the privilege to pass by the north side of the barn one rod wide from the road to the west side of the barn.
